Update: Tracy Morgan’s Time In Wheel Chair To Be Longer Than Expected

One couldn’t help but smile after seeing photos of Tracy Morgan in recovery mode following a near-fatal car crash that claimed the life of a comedian friend. But his attorney says the former 30 Rock star’s having a difficult time getting back to 100 percent.

“He’s really having a tough time,” Benedict P. Morelli said to The Star-Ledger Newspaper.

Morelli’s words follow a six-car accident on the New Jersey Turnpike that left Morgan with a broken leg, nose, and ribs, and claimed the life of his friend James McNair, when their limo bus was hit by a Wal-Mart truck.

What Morrelli describes as an “incremental progress” may leave Morgan confined to a wheelchair for the coming months, according to the attorney.

Kevin Roper, 35, was driving the Wal-Mart vehicle that collided with Morgan’s limo bus; the Ga. native has since pleaded not guilty to vehicular homicide and four counts of assault by auto.

Morgan, however, is suing Wal-mart for negligence.

Trucker In Tracy Morgan Crash Accused Of Not Sleeping For 24 Hours, Sends Crazy Tweet

The truck driver involved in the highway crash that critically injured comedian Tracy Morgan and killed one of Morgan’s colleagues is accused of vehicular homicide and not sleeping for 24 hours prior to the crash.

Kevin Roper, 35, of Jonesboro, Ga., is accused of slamming a Walmart big rig into Morgan’s limo bus early Saturday along the New Jersey Turnpike, police said. The crash killed one man on the limo bus and injured four others, including Morgan, 45.

Morgan’s longtime writing partner, James “Jimmy Mack” McNair, 62, died at the scene.
Roper allegedly “commit vehicular homicide by operating a vehicle recklessly and caus[ing] the death of James McNair, specifically by operating a 2011 Peterbilt Truck … on the New Jersey turnpike without having slept for a period in excess of 24 hours resulting in a motor vehicle accident in violation of NJS 2C 11-51, a crime of the second degree,” according to a criminal complaint from the Cranbury Township Municipal Court.

The document also accused Roper of multiple counts of assault by auto “and causing serious bodily injury” to Morgan, his assistant, Jeffrey Millea, 36, and Ardie Fuqua Jr., 43, a comedian.

Roper was set to appear in court Wednesday to answer charges against him, according to the complaint. He was free today after posting $50,000 bond.

Also the driver of the 18 wheeler was reportedly a road hog and proud of it, tweeting “Trying to win more than lose! Driving trucks for a living. It’s my road. Move or get hit! #Walmart.”

Breaking: Comedian Tracy Morgan Near Death, In Critical Condition After Six-Vehicle Accident

Actor Tracy Morgan is in critical condition after a six-vehicle accident in New Jersey early Saturday, authorities said. The former “Saturday Night Live” cast member and “30 Rock” star was riding in a limo bus when the accident occurred in Mercer County, said Sgt. Gregory Williams of the New Jersey State Police.

The limo bus overturned at the New Jersey Turnpike in Robbinsville, he said.
“The limo bus is the only vehicle that overturned,” Williams said. “Looks like one of the tractor-trailers may have rear-ended that limo bus, but that’s preliminary at this time.”
Williams said he does not believe alcohol played a role in the accident, but that is under investigation.
In addition to the bus, the wreck involved two tractor-trailers and an SUV, he said.
One person was killed and seven others hospitalized with injuries, authorities said. The fatality may have been another passenger in the limo bus, Williams said.
Peter Haigney, a spokesman for the Robert Wood Johnson University Hospital, said four patients are being treated there.

Three are in critical condition and one is in fair condition, he said.
The hospital said that a man named Tracy Morgan was among those in critical condition, but citing privacy laws, declined to confirm it is the actor. State police confirmed his identity to CNN.

Morgan performed Friday night at the Dover Downs Hotel and Casino in Dover, Delaware, the venue said.
