Hold Up: 49s QB Colin Kaepernick Sexual Assault Investigation Is NOT Over

The Colin Kaepernick sexual assault investigation is NOT over yet … despite comments to the contrary from the 49ers QB and the Miami Chief of Police … multiple law enforcement officials tell TMZ Sports.

Earlier this week, Colin told a media outlet, “The District Attorney has the information today. At this point, I’m going to let them handle their business.” 

The Miami Chief of Police Manuel Orosa backed him up … saying, “Our investigation has been presented to our Miami-Dade State Attorney’s Office and we await their decision whether to prosecute or not.” 

Problem is … it’s not true — at least, according to multiple officials directly involved in the investigation. 

We spoke with Lt. Vince Laricci, the Commander of the Special Victims Unit at the Miami Police Department, who tells us, “The investigation is near closure, but it is NOT closed. The State Attorney’s Office does not have our report.” 

TMZ Sports also spoke to a rep for the Miami-Dade Office of the State Attorney who told us investigators are still “waiting for scientific evidence” before kicking the case over to prosecutors. 

As we first reported, the accuser met with cops at a hospital directly following the alleged incident at a Miami hotel on April 2nd … and a rape kit was administered, along with other medical tests. 

For his part, Colin claims he did “nothing wrong” on the night of the incident.

Colin Kaepernick Addresses Sexual Assault Struggle, Disses TMZ

Yesterday April 10, Colin Kaepernick's world and offseason was rocked when he and a couple of his NFL buddies were named in a dicey sexual assault complaint. Although there were no arrests or charges filed, the sports nation and his San Francisco 49ers took great notice to the situation.

Kaepernick has wasted no time getting on his Twitter soapbox to address the recent allegations, as well as denouncing TMZ's report on the matter. "The charges made in the TMZ story and other stories I've seen are completely wrong," the star quarterback stated to the online forum. "They make things up about me that never happened." TMZ alleged that a woman--whom Kaepernick had previously been intimate with--hit a "bong of marijuana," only to pass out after she got naked and Kaepernick begin to kiss her. "I take great pride in who I am and what I do, but I guess sometimes you have to deal with someone who makes things up," continued Kaepernick in his open statement, yet the accounts do indeed match the Miami Police Department report (see here.)  

TMZ was also keen to point out that Kaepernick was vague and unspecific where their scoop was wrong. In conclusion, the 49ers star finished with, "I want to thank all of the people who have shared their encouraging sentiments. I assure you that your faith is not misplaced." Breaking: Colin Kaepernick Sexual Assault Investigation — 49ers QB Being Investigated

San Francisco 49ers quarterback Colin Kaepernick is being investigated for an alleged sexual assault in Miami, Florida … law enforcement sources reveal.

We’re told the alleged incident took place in Miami earlier this month.
Our sources tell us … the investigation is in its “beginning stages” and no charges have been filed against anyone at this point.

We reached out to both Colin’s agent and the San Francisco 49ers — so far, no comment from either one.

Kaepernick doesn’t appear to be fazed by the allegations — he was out partying at a Miami nightclub early Sunday morning with a smile on his face.

Colin was at the Viceroy as recently as April 5th — when he hung out with a wedding party near the pool at the hotel. People in the wedding party tell us Colin couldn’t have been nicer and “made the bride’s weekend.”

According to the police report, the accuser told cops she went to Lockette’s apartment around 9pm on April 1 and saw Kaepernick and Patton.

The woman says she mixed some drinks for the guys and gave them shots, but they told her that “in order to drink the shots she had to ‘hit’ the bong which contained marijuana.”
The woman says she felt lightheaded and went to the bedroom to lie down.

She claims Kaepernick “came up behind her into the bedroom and started kissing her.”
“She advised they were kissing (mouth) and Mr Kaepernick started to undressed [sic] her. She got completely naked. Mr. Kaepernick told her that he was going to be right back and left the bedroom. They did not have sex.”

The woman told cops that while she was still naked in bed, Patton and Lockette opened the door and “peeked” inside. She says she told them to get out … but she can’t remember anything after that.

The woman later woke up in a hospital bed … but says she doesn’t remember how she got there or who took her there.

The woman also claims she has had a sexual relationship with Kaepernick in the past.
10:20 AM PT — The Miami PD has released an “information report” … showing the alleged incident took place on April 1.

According to the report, two other individuals are being questioned — both NFL players.
SF wide receiver Quinton Patton and Seattle Seahawks wide receiver Ricardo Lockette.
According to the report, the alleged incident took place at Lockette’s apartment in Miami.

Sources say the alleged victim later went to the Viceroy Hotel.

Kaepernick was hanging out with Lockette at a nightclub in Vegas just two weeks ago … days before the alleged sexual assault.
